Terms and Conditions
The following terms and conditions apply to every agreement between you, as the client, and La Via Nova, a trading name of I Sea Services.
Last updated: 22 April 2026
Article 1, Definitions
Service provider: I Sea Services, trading as La Via Nova, established in Bennebroek, registered with the Dutch Chamber of Commerce (KvK), with VAT number NL002082932B02.
Client: the natural or legal person who commissions the services.
Services: all forms of purchase guidance, advice and intermediary services offered by the service provider in relation to property in Spain.
Article 2, Scope of Application
These terms and conditions apply to all offers, quotations and agreements issued or entered into by the service provider. Any departures from these terms are valid only if agreed in writing.
Article 3, Independence and Interests
The service provider acts solely in the client’s interests. Under the Begeleiding service, the service provider receives a fee in line with market rates from the Spanish property developer, without this affecting the objectivity of the advice given to the client. Under the Persoonlijk service, the service provider receives payment solely from the client and no commission from any selling party.
Article 4, Formation of the Agreement
An agreement is formed when the client accepts a proposal issued by the service provider in writing, or signs up for a particular service tier (Begeleiding or Persoonlijk) and that registration is confirmed by the service provider.
Article 5, Fees and Payment
No fees are charged to the client for Begeleiding; the service provider receives its remuneration directly from the developer.
Persoonlijk is subject to a fixed retainer fee agreed in advance. If a purchase is successfully completed within the service engagement, 75% of this fee is refunded to the client. The refund conditions are set out in the individual proposal.
Article 6, Performance of Services
The service provider performs the service to the best of its knowledge and ability, in accordance with professional standards of skill and care. The service provider is subject to an obligation of effort, not an obligation to achieve the completion of a transaction at a predetermined price.
Article 7, Liability
Any liability of the service provider is limited to the amount paid out by its liability insurer in the case concerned, plus the applicable excess. If the insurance provides no cover, liability is limited to the amount paid by the client to the service provider in the twelve months preceding the event that caused the loss or damage.
Article 8, Confidentiality
Both parties undertake to keep confidential all confidential information they obtain about each other in connection with the agreement.
Article 9, Cancellation and Withdrawal
As a consumer, the client has the statutory right to withdraw from the agreement free of charge within fourteen days of entering into it, provided that work has not yet begun. Any costs already incurred will be charged.
Article 10, Applicable Law
All agreements between the client and the service provider are governed by Dutch law. Any disputes will be submitted to the competent court in the judicial district where the service provider is established.
